The girl hasn't actually been sued yet, the judge just gave his opinion that there is nothing in law to prevent such an action taking place.
I'm not happy about such a young kid potentially going to court but nor am I happy that an elderly lady was not able to walk safely because, according to the reports, 2 kids were 'racing their bikes' on the pavement.

Guess that will now be argued at the trial, as will the definition of 'racing' and what the parents could/should have done to prevent it. Only winners will be the ambulance chasing lawyers ...

So there was nowt in the old dears estate, so hey lets sue the kids and we'll sue the parents as well just in case the kids have got nowt.
The issue here is not weather the kids or the parents are negligent, it's how much money they can screw out of the families.
